Similarly, it is important for businesses who are selling products and services to understand the obligations they owe to consumers and how to properly deal with consumer complaints and disputes (and other matters such as product recalls) to ensure they comply with the legislation so that the dispute does not become bigger and more costly than it needs to be. Procedures can also be put in place to assist businesses to comply with the legislation to avoid consumer disputes to start with.
Most of these disputes will be subject to the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (or ‘ACL’) that sits within this legislation.
The legislation encompasses a wide variety of consumer rights and guarantees including causes of action such as misleading and deceptive conduct, misrepresentation, unfair contract terms, product recalls, pyramid schemes, unconscionable conduct and more.
Many consumers have experienced misleading and deceptive conduct in their lifetime without realising it. Section 18 of the Australian Consumer Law protects consumers from conduct which is misleading and/ or deceptive if the conduct occurred in the course of ‘trade or commerce’ and is, or is likely to, mislead or deceive consumers.
Examples include falsely advertising that a product or service is capable of something that it is not and hiding information in small print or failing to disclose it at all.
